in theory, the answer would be yes.
in reality, i believe the answer is no. i don't think this panel of judges or any panel of judges has what it takes to reverse the entire conservatorship upending everything fhfa has done to make fannie and freddie safe and sound and prepare them to restructure and exit conservatorship in the coming months once they restructure their equity position with treasury.
yeah, but at least you've identified your hope.. but this would eliminate the explicit limited guarantee of the government for fannie/freddie.
i don't think that's politically possible. and as such, i am not expecting much here.
