This is a bullish case but I believe the FDA encouraged CYDY to file a conditional EUA application to alleviate the FDA of an ethical dilemma. If the FDA insists that CYDY conducts CD16, the FDA will also be forced to end the OLE and eIND approvals otherwise no one would sign up for the trial and risk getting placebo. This puts the FDA in an ethical bind because they have data to indicate the drug works for critical patients. A conditional EUA approval, on the other hand, allows anyone who wants LL to receive it and it also gives the FDA the opportunity to monitor the progress of the EUA patients and react accordingly. It appears to be an elegant solution for the FDA which otherwise might find itself in a tricky situation.
