KBLB is no different than any other company in trying to protect their IP. They will do what they have to do and have hired the best in the biz (Workman Nydegger) to assist should anyone or any entity infringe upon their IP. Even patents aren't a lock for protection. But, again, a company does what it has to do. Not having a patent doesn't stop the company from selling their products to customers, though. So, I say, "la-di-freaking-da! On patents!"

That's right. Now why would they do something stupid like that? Well, let's see...If they were to patent its formula, the formula would become known to others, and once the patent expired, anyone could use it.

In order to stay competitive, a company needs to protect many things that are intangible and therefore harder to protect than tangible assets. No single regime of law, no single type of legal protection, can give a company all the protection it needs for its intangible assets. But with all four of the types of protection taken together (Trade Secrets, Patents, Trademarks, and Copyrights), and properly used, a company like Coca-Cola (or KBLB) can protect its intellectual property against its competitors.
