So I had a little fun today and I overlayed our case timeline to match up another patent trial case to see how the dates line-up and what the next key dates will be as well as what documents we will be seeing and roughly when. I just counted the days in between key events and used our Markman hearing date as the guidepost. The other case (Centripetal v Cisco) had 4 months between Markman and Trial..Again this is just using another case as a baseline and to also note the key decisions the court will make along the next few months following the Markman (This is not definitive stuff on the schedule!!). There will be several catalysts to come in the next few weeks/months as this case progresses. One last note is the Centripetal case was a bench trial and took 22 trial days. Albright has a current case and his Jury Selection was Feb 22 and the case began Feb 23rd…and I do not imagine it will go 22 days…so the endgame of the timeline may be off.

03/04: Markman Hearing
03/15: Court Issues Claim Construction Ruling
04/12: Summary Judgement Motion by Plaintiff
04/15: Settlement Conference
05/24: Motion for Summary Judgement Issued (Denied)
07/06: Jury Selection and Trial set
08/10: Trial Concludes (22 days of actual trial hearings but a bench hearing only)
12/04: Judge Issues Final Opinion/Order

A few things to note is that Albright speeds up things in-between these hearings because he loves phone teleconferences. Instead of getting motion hearings on the docket he will simply schedule a teleconference to listen to each side and he rules pretty quickly and moves the case along (this is all documented in the recent article I shared snippets about). He does not like to delay anything so this case will move quickly.

Claim Construction Ruling will be a massive day for us and NLST. IF this is favorable there really is nowhere left for SKH to turn...other then the CAFC eventually after they either lose bigly or they capitulate and agree to licensing deal.
