~ I'll Address Simply "ONE" Of The Serious (mb) Points Of Contention, The DTC(s) Issued ESC Cusips' ~
Everything I've posted is document supported, and' There's quite a lot more of course that is revealed on the "WMIH" Parent Corporation "COOP" SEC site aligned with the Company's Forward Moves, ... "the Asset Values of WMIH and its Subsidiaries" ... but ?, lets just address this ESC Cusip issue which seems to have many all twisted and up in the air' ...
... "Word Specifics" ... So as I have stated in the past, the WMI-LT NEVER Issued the ESC Cusips, Nor Could or Can the WMI-LT Ever Cancel Them (actually the WMI-LT is done and kosturos is gone) ... So Again, ... As I Have Stated in the past, ... the TRUST being referred to in the WMI-LT "faq" information is the "Depository "TRUST" Company" the DTC ... the "T" of course is standing for the word "TRUST"
So lets check the actual wording ...
direct quoting from the WMI-LT's faq' release;
Point 9; "Escrow CUSIPs (the “Escrow CUSIPs”) were issued by the
Trust on the Effective Date to eligible former shareholders of WMI." ...
now, direct quoting from the ("disregarded") WMI Plan 7 "Disclosure Statement", Obviously The WMI Reorganization's Plan 7' "Dominant Document";
The Trustees ("plural") may conclusively rely upon the distribution instructions received from the Debtors or their agents with respect to contra-CUSIP positions and escrow positions set up by the Debtors or their agents with the Depository Trust Company, and the Trustees shall close and terminate the original CUSIPS after making initial distributions of Creditor Cash and shall have no further distribution obligations thereafter.
"issued by" ... ? ... or, "set up by" ... ? ... read carefully'
So, the confusion and the misunderstanding is and has obviously been, over which TRUST the WMI-LT's "faq" sheet has been referring to, ... and Obviously, it is the "Depository Trust Company", the DTC ... as stated in the Plan 7 Disclosure Statement
So, I wouldn't be concerned over the DTC's Issued ESC Cusips disappearing until the Trustee(s) have completed their distributions still owed' ... the WMI Capital Trust, the 6 remaining non-banking subs, etc., etc., etc., ...
just sayin'
