Blur, you are a bit confused. The original dividend issue of shares is valid. These are what are floating on the open market right now. If one owns XMET shares today, these are the shares that one owns.
The 8.2Billion shares issued by the previous CEO (now deceased) from 2012 onward are the illegal shares and have never hit the open market. Matter of Fact, they never made it to the transfer agent.
