From the court filing it's looking like old management reached out to Moody and tried to find a resolution to regain the company. IMO it's pretty reasonable Moody would agree to work this out with them, and makes him seem more professional. Custodians are supposed to help shareholders regain some value from abandoned companies, but looks like this one had management that wanted to come back in the picture.
