Looks like this has been going on for a while. The article linked below also mentions engineering around it so hopefully they have done so over the past several years since this lawsuit first started.

As far as whether this is integral in the Covid-19 vaccine, I am digging and do not know. Looks like they won 1 and now lost 2 patent lawsuits.
Worst case MRNA would have to pay a fee for use of the patented technology or a royalty which would be worked out. This will not stop MRNA from creating the vaccine and bringing it to market.
