USPTO says Moderna hasn't shown Arbutus patent claims unpatentable The USPTO's Patent Trial and Appeal Board issued a decision posted to the USPTO site that states Moderna Therapeutics (MRNA) filed a Petition requesting institution of an inter partes review of claims 1-22 of U.S. Patent 8,058,069 held by Arbutus Biopharma (ABUS). The final ruling states: "we determine that Petitioner has not shown by a preponderance of the evidence that claims 1-22 of the '069 patent are unpatentable."
