On June 11, 2020, Mr. Schena was released on $2 million bail.

I am the attorney for plaintiffs in the above-referenced action and I respectfully submit this letter to request a pre-trial conference, by telephone or video conference as the Court may direct, to discuss the entry of a partial judgment in favor of plaintiffs and an expeditious trial of the remaining issues in this case. This request is necessitated by the criminal charges filed on June 8, 2020, against defendant Mark Schena (“Schena”) for Conspiracy to Commit Health Care Fraud and for Securities Fraud in connection with his operation of defendant Arrayit Corporation (“ARYC”). A copy of the Complaint in U.S.A. v. Mark Schena, CR 20-70721-MAG, pending in the United States District Court for the Northern District of California, has already been filed in this action.
