Treasury took an exceptional step of appealing when no ruling had, as yet, been given -- since it has been REMANDED BACK TO JUDGE ATLAS albeit with guidance on how to rule.

We should all remember Judge Ginsberg -- remember that oh-so-smart jurist who took a bunch of dots in HERA and connected them however he wanted

Judge Atlas could rule in the same way and leave us with nothing -- sure the plaintiffs would appeal back to 5th. But surely you have learned enough about federal judges to know this is not at all impossible

So, no, NWS has NOT (as yet) been ruled illegal - sorry.
