"Calabria hopes courts don't rule against UST."
In the ONE instance in the 5th where they already have, Treasury/Mnuchin have appealed to SCOTUS (as I predicted from the start they would). The decision whether SCOTUS will even hear the appeal will be kicked down the road for months, no results either way until 2021. All others ruled in favor of Government, and the remainder will languish in delays and continuances now having been given cover by the Treasury appeal as they can claim they're waiting for guidance, or some such nonsense. Calabria is not worried, nor is the Government.
"Calabria is ignoring the situation where the government loses in court or the UST settles."
Calabria and every other person "in the know" are fully aware the Government will NEVER SETTLE. NEVER SETTLE. NEVER SETTLE.
"A capital raise may not be necessary if the courts rule heavily in favor of the plantiffs. Overpayment going to capital and then release!"
Government will NEVER repay one red cent of overpayment. Ever.
"It is all a question of time, sadly. We are at the mercy of the courts."
Wrong. We are at the mercy of the United States Government. Worst case scenario.
