The MM patent will be allowed by USPTO just like the Psoriasis patent did. IMO Only a matter of time. Here is the reason.
"A patent examiner may raise objections to all or some of the claims that are present in the document. … The claims, once rejected, may be amended, and through the amendment one should attempt to ensure that at least one independent claim is in a condition for allowance of grant. It shall be noted that amendment may be done by adding features of different dependent claims to an independent claim, supported by arguments if any.
Hence for a patent application to be allowed for a grant, it is necessary to have at least one independent claim to be accepted for grant by the examiner.
The majority of patent applications have all claims rejected by the Examiner, and yet a majority of patent applications are granted and patents awarded. The reason is that (essentially) nothing is ever final in a patent application. It is always possible to amend the application, make remarks arguing against the rejections, or appeal the Examiner's decision to a higher level. Persistence is often rewarded, and one or more claims are usually allowed in the end.
