Here is TD's response to me about the waiver. I will attempt to do as they suggest later as I have to leave for a few hours and can't call now.

Dear Mr. xxxxxxx,

I apologize that no one at my level could make any exceptions to the rule about HMGP. If you would like to appeal this rule, you may call and request an Apex trading manager.
