So what you’re saying is that if Sweeney concludes consent to conservatorship was forced by duress, the conservatorship can go on, and the future precedents is that duress is no longer a problem in law, as Sweeney in the Wf FnF case concluded in the future everybody can be forced into a contract by duress
This wouldn't set a future precedent because Sweeney's court doesn't have the jurisdiction to overturn the conservatorships. The remedy for a takings is nearly always money because undoing the action itself isn't possible. At this point there is no way to tell what "would have happened" if the boards had not consented to the conservatorships, let alone everything that happened afterwards. Courts don't like to deal with hypotheticals.
If Sweeney does find that the boards were coerced into the conservatorships, all she will do is use that to calculate how much in damages to award to pre-conservatorship shareholders. Trying to unwind the conservatorships, other than just reversing money payments, is what would be unprecedented and contrary to the law.
and since 2012 the government has been accumulating huge problems in this saga
But if the boards were coerced into accepting conservatorship and never needed the bailout, the problems started in 2008. Pick a lane.
if it was not installed, and they were released in 2012/2013 nobody would have made/had a problem
FnF had no capital at that point. There is no way they would ever be released in such a state, regardless of whether the NWS had ever happened.
We all have seen thousands of pages and hundreds of documents, and some unsealed privileged documents by Sweeney, out of all the thousands of pages there is not 1 point that proofs plaintiffs are wrong
Well then, why even bother to have a trial at all?
And realize that all these documents were requested by the plaintiffs. That does not mean that the government does not have documents of its own that tell a different story.
I wouldn’t be surprised “UST00530714” says
An assumption based on the title is not evidence or proof.
