Jonathan Miller Speaks And CBD Legalization Still Appears To Be The Plan
Mr. Miller is Mitch’s right hand legislative man

One regional industry leader called the FDA’s concerns regarding the safety of CBD “overblown.”
“They issued what we believe are so very overblown claims about what would happen if you would take enormous amounts of CBD,” said Jonathan Miller, former Kentucky state treasurer and general counsel for the U.S Hemp Roundtable, an industry group. “They mentioned liver disease, sterility…the types of things where there are indications in very, very large doses in animals. There’s certainly no human experience to that.”
This is very aggressive language
I see no backing down from Mitch’s camp here at all
I actually looked up the package insert for Epidiolex and the FDA pulled all of their information on “CBD side effects” straight from the Epidiolex clinical data

The animal study with fertility side effects was also pulled directly from the Epidolex package insert and that study used ungodly amounts of CBD
When he says “there is no human experience to that,” he is referring to the daily low dose CBD that the majority of OTC consumers take, which is 10-50 mg
In contrast, the average dose of Epidolex is around 1000 mg daily, so there is no comparability there
That’s why everybody who knows what’s going on is so adamant about the FDA’s recent language being very misleading
It sounds to me like nothing has changed with Mitch’s plan to pass legislation, attached to the 2020 Agriculture Appropriations Bill, legalizing CBD in Foods and Dietary Supplements
Miller said CBD companies should not make medical claims about their products given continuing scientific uncertainty surrounding CBD’s effects. But Miller said the FDA is also dragging its feet on rules that would give clarity to businesses about how CBD can be sold.
In the FDA’s defense, the FDCA makes it clear that CBD in Foods and Dietary Supplements is federally illegal
So why would the FDA be in a hurry to make rules for the sale of an illegal substance?
Shouldn’t Congress legalize it first, if they want the FDA to create an interim framework of rules governing labeling, marketing, manufacturing and sales?
Hemp advocates, including Miller, want CBD to be regulated as a dietary supplement, which would allow the compound to be legally added to food products. Because CBD is currently an FDA-approved drug, it currently can’t be added to food products. Miller said he believes it will take Congressional action to allow for this change.
Why would Mr. Miller bring up Congressional action if that wasn’t still the plan to solve this Catch-22?
