3 am hearing meant that "no appearance is required and will be held in chambers."

Clerk answered no it was not, but the judge will answer before 5 pm today... IMO - Since no hearing or appearance is required, this is a slam dunk in favor of the custodian to be - Custodian: KNC, LLC
