Do we need to start a Legal process against LBHI to enforce the Guarantees of the CTs?

My question is , isn't this supposed to be enforced by the entity that was the guardian for the CTs ? IN this case I think it was perhaps Bank of New York Mellon or JP Morgan Chase. Not certain..
