As for the MTD, you're preaching to the choir again except the part where you think it isn't part of the docket and case history. You also seem to think it's meaningless that the Court determined GFSI did not meet Conditions Precedent. Any idea where the FAC shows those conditions were met? Nope, because they never happened. After KPMG and GCP dissed their Federal Court depositions, Rontan was able to get KPMG to stipulate to facts. While GDSI implies the Bolzans didn't cooperate, the opposite is true. KPMG went to Brazil and incurred six figures in charges for their Condition 1 work.Yet, GDSI claims they waived that work requirement? I think BSF didn't fully understand who they were dealing with and all the back story facts when they took this case.
