Nope, no recommendation for charges against Clinton because intent IS taken into account in PRACTICE.

So I m going to go with the guy with experience in law enforcement and I'm going to cosign your post to the bin of RW conspiracy theory crap and wishful thinking.

I don't have imagine anything about Trump. He feigned memory loss in his answers on his take home exam and he refused to submit to questions on obstruction of justice, all of which are listed in that portion of Mueller's report dealing with obstruction.

It's not spin that Trump is individual one in a violation of Federal law. The son of a bitch paid off two women to keep their mouths shut just before the election. Imagine how YOU would treat that if Trump were running as a Dem.

Plus, he's Putin's bitch and, by extension, so are all of his faux-patriot supporters. If the Bolshoi Ballet slipper fits....

The reason that the FBI did not recommend felony prosecution, however, is that investigators never found “a smoking gun,” Comey says. They lacked an email or other record that established criminal intent – perhaps a warning to Clinton that she shouldn’t use a private server or any “indication of her obstructing justice.”

Absent such a damning piece of evidence, there was no precedent to prosecute. And so, in a decision that became the president’s pretext for his firing, Comey staged a press conference in July of 2016 denouncing Clinton’s carelessness in risking classified information, even as he let her off the hook, as a criminal matter.
