Sure looks that way. CEO was supposed to meet with SEC last month, no update whatsoever from him. There has been nothing but bad news here since the end of last summer and only one PR since which was just the CEO defending his company. What would really suck would be to find out they've burned through alot of the $7.5M from the private investor to deal with legal fees.

This is like an incredibly slow sunset waiting to fade over the ocean horizon. I can't believe it's still even worth a penny here.
