The only person who ever said this would be an IPO was Rory. That was long ago and corrected. The SEC is who I spoke to about this and they said an IPO was only possible if a previous one had not been done, which turned out to be the case so this had to be a "Pubic Offering". Interestingly this offering was done much like an IPO even though it was a follow-on offering. The road show for example is more typical of an IPO. I spoke today with a broker at AGP, not someone at the SEC, and no I do not have a recording.
