On the contrary, PwC makes it VERY clear the false statements are that the common shares have value. And that they won't be cancelled, because they will be cancelled, which is why FINRA was notified - they will delete the ticker at any time from this point forward.

BIOAQ shareholders will wake up one morning soon to discover the ticker is gone, and the shares are completely worthless.
