Actually, the overruled demurrers simply mean the claims remain. Problem for Maciora is that he has to prove his claims. He will fail.

On the other hand, the sustained demurrers mean Maciora has to submit a First Amended Cross Complaint, and prove those claims, too, if he chooses to accept his do-over opportunity. He will fail.
