Letter received from US Trustee (so whats next CSNY?)
RE: In re: Washington Mutual, Inc., et al.,
Case No. 08-12229 (MFW)
Dear WMI Liquidating Trust Beneficiary:
Thank you for your recent correspondence about the WMI Liquidating Trust. The Trust was created through a chapter 11 plan filed in the Washington Mutual, Inc. bankruptcy case, which the Bankruptcy Court confirmed on February 17, 2012. In 2014, the Trust filed a 10-K
that discloses the transaction about which you express concern. In your correspondence, you now request that the United States Trustee prepare and file a motion seeking relief from the
Bankruptcy Court on your behalf, to protect your rights as a beneficiary of the Trust. We have received similar form letters from numerous other beneficiaries of the Trust, similarly seeking such assistance.
The United States Trustee Program is a component of the Department of Justice responsible for supervising the administration of bankruptcy cases and private trustees under title 11 of the United States Code. Attorneys employed by the Office of the United States Trustee do
not represent individual constituencies in a bankruptcy case, and are also prohibited from providing legal advice to private citizens. Thus, we cannot file a motion seeking the relief that you request, and we cannot advise you with respect to your rights or the rights of beneficiaries of the WMI Liquidating Trust. If you have questions regarding your rights in connection with the above-referenced matter, please consult with your attorney or financial advisor.
In any complex bankruptcy case, there are of course numerous points of view. We urge all parties in interest in the case to consult with their own personal counsel should they have concerns with respect to how their interests are treated under the confirmed plan.
Very truly yours,
/s/ T. Patrick Tinker
