The SEC does not have criminal authority. They issue civil sanctions. If they discover criminal behavior, then the case gets shipped to the justice department. Most often that is fraud. There is no fraud in the stuff SEVU did. Must be intent for gain. SEVU will most likely be spanked with a monetary penalty by the SEC.

Shamus, why don't you find out how many lead plaintiffs there are for the class actions?
