Withholding federal funds from non compliant states is a ploy they have used many times. Texas balked at integration the fed threatened to stop education funding, Texas integrated. Texas balked at lowering the speed limit to 55 mph the fed threatened to stop road funding, Texas decided 55 mph was a great speed limit. For many years afterward it wasn't enforced until the fed starting monitoring highway speed and renewed their threat.
