actually suing them and a class action lawsuit and putting them in bankruptcy is the best action possible at this time because if the assets were real then bankruptcy would force them to liquidate in which case the common shareholders would then see the value of the assets but since there are no assets you're absolutely right suing them makes no sense at all because all it will show is that they never had anything of value to begin with
