Mad: There was language that pointed the PTAB to the fact that there have been recent decisions made by the CAFC - during the time this case was being considered - that would impact the PTAB's review of the remand. My read is that the PTAB will now have to follow newly-established law without the opportunity to create their own. Sure, we could still get a Dyk on the next Board, who makes his own law. But the only downside to this ruling (gutless as it was, since the CFC could easily have vacated without remand) is time.
