You are talking about a typical reorg. But everything can be ruled by the bankruptcy court and it was done as defined in POR 7 which says clearly that the reorg company WMIH has the NOL and WMMRC. End of story.

Everything else will go to the liquidating trust which will ... liquidate and return cash to those who signed release using the 75/25 split until the end. End of story.
