2.2 is not applicable in this case to avoid a plant update if it is running economic today. They don't have to disclose negotiations, however they do have to advise if the plant is economic because that won't impede negotiations. If one company has discovered a secret use for another company's tech or their mine then they don't have to disclose that because that would bid up the price of it and harm their chances of a deal. Since both companies are working together to make this plant work, there is nothing that a plant update nr would do to impede negotiations.
