Maybe you took my words out of context or maybe I’ve misstated so Ok... I guess I’ll state what Tom said verbatim via Twitter.

Sounds like an agreement to me, and today’s 8-k, at least to me shows part of that agreement. So no they don’t have control over when the notes convert but they can come to an agreement on how to pay for those notes before or once they convert. Better?
