FFB-Ameritrade told me your shares can't be used if you have a cash account. They can use your shares for shorting if you have a margin account (I asked if they shorted penny stocks and they said some but wouldn't give me their symbols-lol). I was also told that if you call TDA and ask that your shares not be used for shorting they have to honor that request, and they put a note to that effect in your account. I've called, and then called them back to verify that the shares in my margin account are not to be used for shorting - they stated they can't. So I guess I'm cool with that. Some TDA users have requested in writing that their shares can't be used for shorting and they've received e-mails to that effect. Just a FWIW.
