Well in the first place I do not believe the governing trust document permits any exchange. The law always looks at substance over form. In substance even if a third party exchange is used, the courts would view it as wmih buying it directly from the liquidating trust. This is especially true if the exchange company used is a subsidiary of wmih and not an independent one. imo
