1. The parties have met and conferred, reached a settlement in principal, and expect to present a dismissal order to this Court no later than October 27, 2017.

2. October 5, 2017, the parties reached an agreement in principal to settle this matter.

3. As a result of the agreement in principal, the parties have signed a term sheet and are working in good faith to prepare a formal settlement agreement and draft dismissal orders. The parties expect to complete these matters before October 27, 2017.
