The SEC suspends for being delinquent in the filings and fraud.
From the SEC Order suspending BITCF.
"The Commission temporarily suspended trading in the securities of BITCF because of concerns regarding the accuracy and adequacy of publicly available information about the company including, among other things, the value of BITCF’s assets and its capital structure. This order was entered pursuant to Section 12(k) of the Exchange Act."
Providing false and misleading information is fraud.
This is exactly the wording the SEC uses in a suspension order for fraud.
Here is the suspension order for CYNK.
"The Commission temporarily suspended trading in the securities of CYNK because of concerns regarding the accuracy and adequacy of information in the marketplace and potentially manipulative transactions in CYNK’s common stock."
The CYNK insiders were prosecuted for fraud - and as you can see the SEC didn't use the word fraud.
Gregg Mulholland and Robert Bandfield have been sentenced - Phil Kueber is awaiting sentencing.
It seems that many think the word fraud must be in the SEC Order for the suspension to be for fraud but that isn't accurate.
