You seem to misunderstand. DD3 reviewed the current patent applications made by Tmmi. He didn't review old fractal patent applications. He reviewed the applications that Tmmi is making to protect their current technology.

It's true that he thinks the old fractal stuff is junk. He also thinks the dimension technology is junk. And he thinks the new patent applications by Tmmi are junk too. He thinks the whole enterprise and contest is a waste of time because other technologies have beaten both parties to market.

The obvious way of refuting his opinion is for a company to put out a product valued by a purchaser. But he is so far not refuted, as there is no demonstrated commercial use of significance related to the tech of either company. That matters more than anything else. Especially this dumb counterclaim.
