At every stage of litigation the risk outcome has a probability change that could effect the market price of the equity. This has played out time an time again and is nothing new to those who follow these stocks. The decision to seek the Appeal influences both the stock price and the long term prospects. Indeed I would rethink my position if Justice Wallach and Mayer sit on this Appellate mini board-solely based on how they've harshly ruled against previous PAE's. When you see an Appellate Judge volunteer to defend claims that a Defendant did not include in his brief (Vringo) you are somewhat taken back by the fairness and impartiality of the Judge(s). I realize you don't want to hear this but for me its a real risk that has to be weighed. Others may also feel the same. I post freely here and present this as just my humble opinion. In most cases I post AFTER Market hours as well.
