In the year 2000, Simpson, President of DFI, negotiated a buy price of $500,000 to buy this code from Iterated. As you are aware, Iterated also demanded 5% of the new company's stock to close this deal. Simpson, with Panik, Hoyt, and many others, formed a C corp. (DFMI) to close the deal and take delivery of VDK2.0. They (DFMI) also paid Iterated an ongoing development fee to fine tune the codec.
This is my understanding of how and when Simpson gained access to the codec.
