Possibly because in her testimony, while she did deliberately switch the arms, she did not intend to destroy, damage or obstruct. She simply believed that PPHM knowing which dose was in which arm of the trial meant the trial wasn't properly blinded. Hence stupidity, not sabotage.

Also could be why PPHM did not file for intent, it wasn't there.
