Sherman is brilliant and very clever. He founded Barr Labs as well and he used to be the controlling shareholder. He's been liquidating brl shares in an orderly way for nearly 10 years and is still a 5% shareholder. Only $250M+ in shares left
All you can say is he took Bristol to the cleaners on this deal. This is embarassing.
Will be fun to see how much money Apotex makes on this. Assuming gross margins after distribution costs of 80% Sherman could make huge money on this even if Bristol ultimately wins the case and the agreed to damages. So bristol agreed to a deal that left apotex with no downside, launch later or launch now if the deal was rejected.
