Cheynew, there was a post by ku. I didn't see where in the proxy it states it. I don't think it does. But a company would be foolish not to apply for an extension. Either that, or the company is expediting the process of going private (being bought at artificially inexpensive market cap forced down by the ineptitude of this BOD).
