What a bunch of BS! Compaints move forward? "Wait" to see evidence? Lmfao! Guess what? The evidence was supposed to be in the complaint. Instead the mikkin's attached unsigned agreements of a different company. Too funny!
I've read both the mikkin's complaint which reads like a comedy and the motion to dismiss which reads like an classic novel. The only complaint moving forward will be the 13 people individually suing the mikkin's after their ridiculous complaint falls flat on its face and is dismissed with predjudice.
Jury trial? People get this from watching too much TV. Contract disputes never make it to trial. Do you really think a jury is gonna hear about their crappy furniture left in someone else's storage unit, and how donna wasn't paid minimum wage as a CEO? Hahahaha! Taking this to a jury would cost $500k, minimum. My guess is the mikkin's couldn't even afford the discovery. Just like ahmad's San Diego case. It's all smoke and mirrors, trying to extort a settlement. I wonder how that's working out for ahmad? Lol!
Let's look at the facts. The mikkin's fail to name a single party or instance of how they have been defrauded. Instead they filed a blanket fraud suit against 13 people, void of any contracts, agreements or facts. In order to sue someone for fraud, one must name who, what, how and where. Also, one cannot sue for damages until there are damages. Mikkin's claim they haven't sold. Well,.. there are no damages until they do sell. Duh,...
The suit alleges the mikkin's were victims of fraud because the filings omitted the $300k note. When in fact that note is stated in every filing! And I might add every filing signed by donna! How can a CEO sue a company for fraud when / if the alleged fraud is perpetuated by the CEO? How stupid can one be?
Oh,.. I almost forgot. Lawsuits regarding securities have a one year statute of limitations! Ooops! Looks like the mikkin's f'ed up and opened up a Pandora's box of counter-suits.
