There is no reason why he couldnt that anyone can see. If there is a reason it is not public. The SOE report could contain such info but it never materialized.
The only obvious reason that they didnt is because scott never planned on mining. Scotts plans consisted of making a believable story and using that story to fleece his shareholders so he could live the life he wanted without working for it.
