Understood, but in that extreme case, the exercise price is trivial, and the tax cost is covered by the sale of shares at the higher value (permitted under the insider trading rules), so you essentially get a free capital loss. But in cases where you need to go out of pocket real $$ to fund the exercise, I'm saying the result may be different.
