Good insights. My understanding of summary judgement for patent litigation, is that the judge sides with the plaintiff unless the case is obviously prejudiced. In this case, because of the patents issued, the judge had no choice but to rule in favor of TRCA. However, TRCA may have slit its own throat because I don't know how they will defend this patents as inventive. I posted two links to articles that show that other scientists had not only thought of but proved the concept of expressing IGF in e. coli as a fusion protein. Those articles dated before the submission of the '414 patent.

one thing we do know, it will be an interesting trial.
