I just called the court office to try and get an update. I spoke with two different people. The first person said that no trial date has been set yet. She then transferred me to another person who gave me just a little more info. He said the the judge, Melvin Schweitzer, whose been working this case is retiring. I asked him if it would delay anything, he said no. As soon as it's reassigned, if it's reassigned with a new judge we'll be updated. He also said that the judge is retiring but could possibly finish the case. My assumption still is that the two sides are working together for a settlment. For those that want to call the courts and report anything new you can call 646-386-3600 and give them the index case which is 650321-2012. When prompted press 2 for the Supreme Court then press 3 for the commercial division then you'll get a court representative.
