keyownknee, I will answer that since no one else did. Section 382 calls for the NOLs to be used the company that created them must still be owned by 51% of the original shareholders. That is the whole reason for the OBS. Equity shareholders now own 100% of the NOLs. It is also why equity shares were cancelled and not allowed to be transferred. This allowed the NOLs to be used during the liquidation. Monetizing them by current equity once the liquidation is complete will be impossible as there will no longer be any NOLs after cancellation of debt certificates are issued to creditors not being paid for their full allowed claim.
