I'm not sure I understand your point. Menon did not give up shares for a piece of K revenues.
Menon parted with 1/2 of his shares (approximately) AND 1/2 of his royalty on K revenues.
My view is that Menon had other options, but chose to go with the deal as announced to allow CTIX to proceed with business uninterrupted. I think Menon made a huge personal sacrifice for the benefit of the company and shareholders.
