The outsanding amount for the PIERS is 97MM in total. As of the last quarterly report of the trust the net assets of the trust were 264MM, which includes the disputed claims. If we were to deduct the distribution made to the PIERS on Aug 1st (78 MM) then we have 185MM left including the disputed claims (106MM). There should be enough the close out the this class, but as you pointed out the judge needs to bring down the gavel. Also the FDIC needs to finally make a call on those settlements, but they have no urgency to move...
